Frequently Asked Questions Related to Gambling
Question: What is gambling?
Answer: Gambling involves three elements: Prize, Consideration and Chance. If one of these elements is removed, it is no longer a gambling activity. For example, if you pay a fee to play a game of chance (such as poker, blackjack, bingo, roulette, craps, slots, etc.) for a prize, it is a gambling activity. However, if you play these games for free (no entry fee or wager) it is not a gambling activity.
Question: What happens when a slot machine malfunctions?
Answer: When a malfunction occurs the slot machine will normally not accept additional coins nor play existing credits, the lights on top will flash, the readout on the face of the machine will likely flash or display an unusual number or code (example: 3300 code), the reels may stop briefly then rotate or spin slowly, or there may be an on-screen indication of the problem, such as "hopper empty" or "call attendant."
Question: If a casino discharges a gaming debt, is this a reportable transaction?
Answer: No, since a casino does not meet the meaning of "applicable financial entity" per Internal Revenue Code section 6050P(a), there is no reporting requirement in the discharge of a gaming debt.
